Eighth Judicial District Court

Tribunal del Octavo Distrito Judicial

Statement from Chief Judge Jeff McElroy:

8/29/2018 Update

There has been exceptional public interest in the five defendants arrested at a compound in Northern Taos County. The following information is being offered to help the public understand the recent rulings in these cases-

Two district judges have ruled that that the original cases had to be dismissed because the 8th Judicial District Attorney’s Office failed to request a preliminary hearing in ten days as required by court rules. These cases were dismissed without prejudice which means the DA can refile them. You can read both judges’ rulings here and here. To review the rule click here.

The Court held a first appearance on new charges recently filed against two of the defendants. You can see the new charges here. These defendants will remain in custody until a hearing on a no-bond hold motion next week.
